Any British person who worked with and was exposed to asbestos in the UK but has since moved to a foreign country – whether Australia, Spain, South Africa or elsewhere – is entitled to make an expat asbestos claim if he or she has since been diagnosed with an asbestos-related illness such as mesothelioma or asbestosis. Furthermore, it may be possible to apply for an industrial injuries pension and a lump sum payment from the relevant UK government agency.
Industrial Injuries Disablement Benefit
At present (2016) the UK Government accepts only asbestosis, mesothelioma, lung cancer, and unilateral or bilateral diffuse pleural thickening as eligible illnesses for claims of Industrial Injuries Disablement Benefit.
In addition, to qualify, applicants must demonstrate that they suffered asbestos exposure while spraying asbestos, manufacturing asbestos products, working with asbestos insulation or working in ship building.
An additional criteria for eligibility is that exposure must have occurred for five years (if prior to 1975) or ten years (if later than 1975).
Your right to an expat asbestos claim
Making a claim for Industrial Injuries Disablement Benefit should not inhibit your right to make a civil expat asbestos claim.
Diffuse Mesothelioma Scheme 2008
If you have developed mesothelioma as a result of non-occupational asbestos exposure it may be possible to claim a lump sum payment under this scheme. Examples of situations where you might claim under this scheme are; if you suffered exposure while washing contaminated work clothes, if you lived near a factory that used asbestos, if you suffered exposure while self-employed or if you cannot trace your exposure but know it occurred in the United Kingdom.
Asbestos Claim Centre – compensation for expats
If you believe that your asbestos exposure occurred while you were the responsibility of an employer in the UK, it may be possible for you to claim compensation through the specialists at Asbestos Claim Centre, even if you now reside outside of the United Kingdom.
